Outlier Collective, Inc.
This Content Provider Agreement ("Agreement") is a legally binding contract between Outlier Collective, Inc. (DBA "Stacked", "we", "us") and the undersigned content creator/model ("Provider", "you"). This Agreement governs all content, including but not limited to photos, videos, and audio ("Content"), that you upload, promote, or provide to the Stacked platform.
Eligibility and Mandatory Identity Verification
To upload any Content to Stacked, you must meet the following criteria and undergo full identity and age verification ("Know Your Customer" or "KYC" process):
Age Requirement: You must be at least eighteen (18) years of age, or the legal age of majority in your jurisdiction, whichever is older.
Verification Process: You must provide Stacked with valid, government-issued photo identification and complete our biometric "liveness check" to verify your age and identity.
Accurate Information: You represent and warrant that all information provided during this process is true and accurate. Failure to complete this process will prevent you from uploading content or receiving payouts.
Co-Modeling and Third-Party Content
You are prohibited from including any other individual(s) ("Co-Models") in your Content unless you have:
Verified that all Co-Models are at least eighteen (18) years of age.
Obtained a signed, written release and consent form from each Co-Model for the distribution and monetization of the Content featuring their image, likeness, and voice on Stacked.
You agree to maintain a secure digital copy of the age verification (government ID) and the signed consent release form for every Co-Model. You further agree that Stacked has the right, at any time, to demand a copy of these records for audit purposes. Failure to provide these records promptly may result in content removal and account termination.
Prohibited Content and Takedowns
Stacked maintains a zero-tolerance policy for specific types of content. You agree that you will not upload, promote, or share Content that depicts, encourages, or involves:
Non-consensual acts or sexual violence.
Minors, including real or perceived depictions.
Human trafficking or sexual exploitation.
Illegal content.
You acknowledge that Stacked actively monitors the platform and will remove any violating Content and/or suspend or terminate your account without notice. For more information on removing Content or filing an appeal, please see our Complaints, Takedown, and Appeals Policy.
Grant of License
You retain ownership of the copyright in your Content. By uploading Content to Stacked, you grant us a worldwide, non-exclusive, sublicensable, and transferable license to host, display, distribute, and monetize that Content to our users.
Indemnity
You agree to release, indemnify, and hold Outlier Collective Inc and its affiliates and their officers, employees, directors, agents, and advisors from any and all claims, losses, damages, liabilities, costs, and expenses, including but not limited to, attorneys’ fees, arising out of a breach by you and any user of your account of these Terms or arising out of a breach of your obligations, representations, and warranties under these Terms.
Record Keeping (18 U.S.C. § 2257 Compliance)
All content provided to and hosted on Stacked, and all persons appearing in such Content, are strictly compliant with the requirements of 18 U.S.C. § 2257 and 28 C.F.R. Part 75.
By uploading Content, you acknowledge your own legal responsibility as a producer to maintain age and identity records for yourself and any Co-Models. Furthermore, you explicitly authorize Outlier Collective, Inc. to act as the secondary Custodian of Records for the identification and age verification documents collected during your onboarding and KYC process.
